Chin Chin LLC Boat Rentals

These Terms & Conditions (“Terms”) govern the use of the BOATNAPA website and all boat rental services provided by Chin Chin LLC, a California limited liability company.

BOATNAPA is a product and service operated by Chin Chin LLC.

By accessing this website, completing a booking, or participating in a boat rental, you agree to these Terms & Conditions.

If you do not agree, you must not use this website or services.

1. COMPANY IDENTIFICATION

Boat rental services advertised under the BOATNAPA name are operated by:

Chin Chin LLC

Napa, California, USA

All bookings and agreements are entered into with Chin Chin LLC.

2. DEFINITIONS

Primary Renter — the individual completing the reservation and accepting agreements on behalf of all participants.

Renters — all individuals participating in the boat rental, whether or not they personally complete booking.

Released Parties — Chin Chin LLC, BOATNAPA, and their owners, members, managers, officers, employees, captains, tour guides, contractors, affiliates, and representatives.

3. SERVICES PROVIDED

Chin Chin LLC provides private boat rental experiences conducted on the Napa River.

Due to fluctuating tides, currents, shoaling conditions, and navigational hazards of the Napa River, all boat rentals include a tour guide who serves as the sole operator and driver of the boat, designated by Renters.

Renters are not permitted to operate or control the boat.

4. ELIGIBILITY & AUTHORITY TO BOOK

By making a booking, the Primary Renter represents that they:

  • Are at least 18 years of age;
  • Have authority to agree to contracts on behalf of all Renters;
  • Agree that all participants are bound by accepted agreements.

5. REQUIRED RELEASE OF LIABILITY

Completion of a booking requires acceptance of the Boat Rental Release of Liability and Assumption of Risk Agreement.

The Primary Renter’s acceptance:

  • Constitutes agreement on behalf of all Renters;
  • Serves as a legally binding electronic signature;
  • Is enforceable under the federal E-SIGN Act and California law.

Bookings cannot proceed without acceptance.

6. DESIGNATION OF BOAT OPERATOR

Due to Napa River navigational risks:

  • Renters designate the Chin Chin LLC tour guide as the boat driver and sole operator of the boat.
  • Renters may not steer, operate, or control the boat.
  • Failure to follow instructions may result in immediate termination of the rental without refund.

7. ASSUMPTION OF RISK

Participation in boating activities involves inherent risks including injury, death, property damage, environmental hazards, and water-related dangers.

By participating, Renters voluntarily assume such risks as further described in the Boat Rental Release of Liability and Assumption of Risk Agreement.

8. BOOKINGS, PAYMENTS & CONFIRMATIONS

Rentals are confirmed after successful payment processing and completion of the Boat Rental Release of Liability and Assumption of Risk Agreement.

Pricing may change prior to confirmation.

Chin Chin LLC reserves the right to refuse or cancel bookings for safety, operational, or legal reasons.

9. CANCELLATION POLICY

Cancellations made more than 3 days prior to the scheduled cruise date may qualify for refund or rescheduling.

Late cancellations and no-shows are non-refundable unless required by law.

Weather or safety cancellations may be rescheduled or refunded at the discretion of Chin Chin LLC.

10. ALCOHOL, CONDUCT & SAFETY

Chin Chin LLC may terminate a rental without refund if participants engage in:

  • Unsafe conduct,
  • Excessive intoxication,
  • Illegal activity,
  • Failure to follow tour guide instructions.

Renters remain financially responsible for resulting damages.

11. DAMAGE RESPONSIBILITY

The Primary Renter agrees to financial responsibility for:

  • Damage to boats or equipment,
  • Damage to docks or third-party property,
  • Missing items,
  • Excessive cleaning.

Authorized payment methods may be charged for verified damages.

12. MINORS

Minors must be accompanied by a parent or legal guardian or an authorized adult who accepts responsibility on their behalf.

13. MEDICAL EMERGENCIES

Renters authorize Chin Chin LLC personnel to obtain emergency medical assistance if necessary. Participants are responsible for all medical expenses incurred.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by California law and applicable federal maritime law, the Released Parties shall not be liable for injury, death, property damage, or losses arising from participation in boat rentals, except where liability cannot legally be waived.

15. INDEMNIFICATION

Users agree to defend and indemnify the Released Parties from claims arising from:

  • Participant conduct,
  • Violations of these Terms,
  • Third-party claims related to rentals.

16. ELECTRONIC COMMUNICATIONS & SIGNATURES

By using this website, users consent to electronic communications and agreements.

Electronic records and checkbox acceptance constitute legally binding signatures under applicable law.

17. ARBITRATION & JURY WAIVER

Any dispute arising from website use or rentals shall be resolved exclusively through binding arbitration in California.

Users waive:

  • Trial by jury;
  • Participation in class or representative actions.

18. GOVERNING LAW

These Terms are governed by:

  • The laws of the State of California; and
  • Applicable federal maritime law.

19. WEBSITE USE

All website content, branding, and materials are owned by Chin Chin LLC and may not be reproduced without permission.

Users agree not to interfere with website security or functionality.

20. MODIFICATIONS

Chin Chin LLC may update these Terms at any time. Continued use of the website or services constitutes acceptance of revised Terms.
